Foreign Supplier Verification Program (FSVP) Agent

Under the Food Safety Modernization Act of 2011 (“FSMA”), certain importers in the United States are responsible for developing Foreign Supplier Verification Programs (FSVPs) to assure their non-U.S. suppliers are producing food in compliance with processes and procedures that provide, at minimum, the same level of public health protection as those required under section 418 (Hazard Analysis and Risk-based Preventive Controls, or “HARPC”) or section 419 (Standards for Produce Safety) of the Federal Food, Drug, and Cosmetic Act.

FDA’s FSVP rule defines “importer” as the U.S. owner or consignee of an article of food that is being offered for import into the United States. Suppose there is no U.S. owner or consignee of an article of food at the time of U.S. entry. In that case, the importer is the U.S. Agent or representative of the foreign owner or consignee at the time of entry, as confirmed in a signed statement of consent to serve as the importer under this subpart (21 CFR 1.500).
